• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
• Orders mean a request by You to purchase online courses from Us.
• Online Courses/Products refer to the items offered for sale on the Service.
• Promotions refer to contests, sweepstakes or other promotions offered through the Service.
• Service refers to the Website.
• Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
• Website refers to EcoSkills, accessible from http://www.ecoskills.academy
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Placing Orders for Online Courses/Products

By placing an Order forOnline Courses/Products through the Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order for Online Courses/Products available on the Service, you may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your Address, Your Company, Your Professional Status, and Your billing address.

You represent and warrant that: (i)You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct, and complete.

By submitting such information, You grant us the right to provide the information to secure third-party payment processor for purposes of facilitating the completion of Your Order.

Group Courses

1. If you are ordering an online course for more than one individual, then you may contact us here to ensure that everyone will have a personal account (username and password) to access the course.
2. If you are you ordering online courses as a business, please use the online form which is available here. You must state your contact name, email address and the full company name of the employing organization. Upon request We will provide details of the registrations process and any group discounts that may be available.

Time based access

All our online courses are offered on a limited time-based access. The courses typically require 18-20 hours for You to complete them. However, You must complete the course within the timetable of 6 weeks. The course timetable will operate from the date you receive our email to access the course.

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

• Online Courses/Products availability
• Errors in the description or prices for Online Courses/Products
• Errors in Your Order

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

Your Order Cancellation Rights

Your right to cancel an Order only applies to the Online Courses/Products that are purchased within a timeframe of 14 days from the date of purchase. To be able to cancel an Order You must not have accessed or started the purchased Online Courses/Products during this timeframe.

We will refund You no later than 14 days from the day on which We receive such an inquiry via email at info@ecoskills.academy. We will use the same means of payment as You used for the Order, and You will not incur any fees for such refund.

You will not have any right to cancel an Order for the supply of any of the following Online Courses/Products:

• The supply of Online Courses/Products made to Your specifications or clearly personalized.
• The request is received after the 14-day cancellation timeframe.
• You have started the Online Courses/Products. 

Availability, Errors, and Inaccuracies

We are constantly updating Our Online Courses/Products content on the EcoSkills training platform. We may however experience delays in updating information regarding our Online Courses/Productsand in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Prices Policy

The Company reserves the right to revise the prices of its online courses/products at any time prior to accepting an Order.

Prices quoted may be revised by EcoSkills following to accepting an order in case any matter beyond the control of the Company takes place such as a government action, increased charges on behalf of third-party companies or other. In this case you have the right to cancel your Order.

Payments

Online Courses/Productspurchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard, American Express cards via Stripe and PayPal.

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable non-providing of Online Courses/Products to your personal account.

A wire transfer to EcoSkills bank account following an invoice inquiry to info@ecoskills.academy is also accepted. Check payments are not applicable to Ecoskills.

Promotions

Any Promotions made available through the Service may be governed by rules that are separate from these Terms.

If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

User Accounts and Access to Online Courses/Products

To purchase and access an Online Course/Product you need first to create a personal account on the EcoSkills website. The information required to create an account are Your full name, email address, Your organization, Your Country of residence/occupation, a username and password. You must provide Us information that is accurate, complete, and current always. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on EcoSkills training platform. You also have the option to create an account based on your Social Media credentials (LinkedIn, Google, Facebook).

You are responsible for safeguarding the username and password that You use to access Ecoskills online courses on the training platform and for any activities or actions under Your username and password, whether Your username and password is with Our website or a Third-Party Service we collaborate with.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

Users are exclusively responsible for ensuring that they have an internet service as well as sufficient and compatible hardware, software, telecommunications equipment to use the Online Course/Product by EcoSkills. 

Our License to You

Subject to these Terms and our Policies, we grant you a limited, personal, non-transferable license right to use our Online Course/Product. The rights granted herein are only for your personal, non-commercial use, unless it is permitted by EcoSkills in writing. You also agree that you will create, access, and/or use only one user account, unless permitted by EcoSkills.

You are not allowed toprovide access to your account or access information for your account with any third party. The content you access is intellectual property and ownedby Ecoskills for which you have no authority to use it as your own.

Content

Your Right to Post Content

Ecoskills allows You to post Content such as questions, assignments, posts you make in the Discussions/forums. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.

You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Content Restrictions

The Company is not responsible for the content of the Service’s users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

• Unlawful or promoting unlawful activity.
• Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
• Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
• Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
• Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.
• Impersonating any person or entity including the Company and its employees or representatives.
• Violating the privacy of any third person.
• False information and features.

The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Content Backups

Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.

Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

Certification Process and Use

A solely personal digital certification is issued by EcoSkills and made available to registered users who have completed their payment of Online Course/Product and only after they successfully concluded the whole training process (including final quiz and evaluation). 

Digital Certificates provided by EcoSkills are valid for a period of 24 months defined as the period between the issue date and the end date as stated on the certificate. Certified individuals are only permitted to use and demonstrate their certificates during the specific timeframe.

Copyright Policy

Intellectual Property Infringement

All the content of the web pages of this website, including images, graphics, photographs, drawings, texts, services provided (online courses) are the intellectual property of Ecoskills and are protected under the relevant provisions of Greek law, European law and international Conventions and Treaties.

Any copying, analogue/digital recording and mechanical reproduction, distribution, transfer, downloading, processing, resale, in part or in whole, of the content of the website for any purpose is prohibited unless you have been provided with our written consent. The names, images, logos, and distinctive features that represent the Company and its services, this website and the services provided on it are exclusive trademarks and distinctive features of the Company and are protected by Greek, Community, and international law. Their appearance on the site should in no way be construed as a transfer or assignment of a license or right to use them. 

If You are a copyright owner, or authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, You must submit Your notice in writing to the attention of our copyright agent via email at info@ecoskills.academy and include in Your notice a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any Content is infringing Your copyright.

Limitation of Liability

The Company always acts in good faith and within the limits of the law and these terms and conditions. Therefore, it has taken and continues to take all necessary technical or other measures and makes every effort to ensure that (a) this website is operational and that the online courses are provided continuously and correctly without problems, interruptions, delays, errors or mistakes; (b) the data/information provided and transmitted via this website is not altered and is protected by backups, since the security systems of this website are protected by the use of a backup system;  (c) the technology used by the Company or the servers through which the online courses are made available to the Users does not contain viruses or other harmful components or software programs; (d) the online courses are provided uninterrupted and error-free, however, the Company does NOT OFFER ANY WARRANTIES for all of the above and is not obliged to compensate you in case you suffer any damage for the above reasons.

Furthermore, the Company does not guarantee the suitability and effectiveness of the courses for the specific purpose for which they are intended.  

The Company accepts no responsibility for any technical problems that users may encounter when attempting to access this website and during access thereof, which are related to the operation or compatibility of their own infrastructure with the use of the website. 

Furthermore, it has no responsibility for acts or omissions of third parties, and in particular unauthorised interference by third parties with services and/or information made available through this website. 

In addition to what is expressly set forth herein, the Company shall have no civil, criminal, or otherwise liability to you and/or any third party that draws rights from you, in the event that any of the above, while using the services of this online store, suffers direct, indirect, consequential, incidental, economic or other damages, or loss of profits, due to: (a) errors, omissions, technical stoppages, failures or malfunctions of the telecommunication networks, the Internet, the website, the Internet Service Providers; (b) permanent or temporary interruption of the website or certain of its services and/or interruption of the provision of certain services through the e-shop, (c) events, situations, actions, acts and/or omissions of the Company or third parties for which the Company does not provide guarantees and is not liable as set forth herein; (c) information and other content that may be published and communicated by third parties.

The Company: (a) reserves the right at any time to discontinue the operation of all temporarily or permanently or part of this website for maintenance or upgrade purposes or for any reason; (b) can provide no guarantee of the availability of the services provided but guarantees to inform users in a timely manner of their unavailability. 

The Company does not control and does not make any preventive control of the content and information published and communicated by third parties and is not responsible for them. 

The Company shall only be liable for fraudulent and gross negligence in the event of damage to you from information or services provided through this website. 

The Company reserves the right at any time, without justification and without any compensation, to interrupt or terminate the provision of its services and/or its operation permanently or temporarily without any obligation to inform the members beforehand. The Company shall only be liable for direct damage resulting from its fraudulent intent or gross negligence.

Without prejudice to mandatory provisions, the Company’s liability for direct damage caused by ordinary negligence is expressly excluded, irrespective of the legal grounds. 

The Company’s liability for indirect or consequential damages is completely and expressly excluded – irrespective of the cause.

Your Feedback to Us

You assign all rights, title, and interest in any Feedback You provide to EcoSkills. If for any reason such assignment is ineffective, You agree to grant EcoSkills a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Links to Other Websites

Our Online Course/Product may contain links to third-party web sites or services that are not owned or controlled by EcoSkills. 

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue EcoSkills.

Governing Law

These Terms and Your use of the Service shall be governed by Greek law. 

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company. Any dispute, controversy or claim arising out of or in connection with these Terms and Your use of the Service shall be finally resolved by the competent courts of Athens.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 15 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
